1.  Original – Design protection is grantee for work which is original.

2.  Intellect and skill – the designer should have expended intellect and skill in the creation of the design.

3.  New application – Design protection is granted for such designs which though old are new in their application.

Designs in India are governed by the Design Act, 2000.

Registering Authority:  Patents and Design Registry.

Any person claiming to be the proprietor of any new or original design not previous published in any country, and desirous of registering it may apply for design registration.

Person includes individuals, partnership firms, company (Pvt. or Public) or any other legal entity.

1. Once Registration is granted it is valid for ten years from the date of filing the application.
2. After the expiry of the first ten years the registration may be renewed for another 5 yrs only.
